Welcome to Shumbi.

Shumbi is an Australian platform designed to help people discover local, in-person events and connect with creators in their communities.

These Terms of Use ("Terms") explain the rules that apply when you access or use the Shumbi website, mobile applications (if available), and related services.

By accessing or using Shumbi, creating an account, or submitting content to the platform, you agree to these Terms.

If you do not agree with these Terms, you should not use Shumbi.

Shumbi exists to make it easier for people to discover meaningful local experiences while supporting the creators, organisers and communities that bring those experiences to life.

We aim to provide a welcoming, trustworthy and community-focused platform that encourages authentic events and genuine connections.

While we strive to provide a reliable service, Shumbi is a discovery platform. Events are organised and delivered by independent creators, not by Shumbi unless expressly stated.

You may use Shumbi if you:

• comply with these Terms;
• use the platform lawfully;
• provide accurate information when creating an account;
• are legally permitted to create an account under the laws that apply to you.

If you are under the minimum age required to create an account in your jurisdiction, you should only use Shumbi with the involvement or permission of a parent or legal guardian.

To access certain features, you may need to create an account.

You are responsible for:

• maintaining the confidentiality of your login details;
• keeping your account information accurate and up to date;
• all activity that occurs through your account unless you notify us of unauthorised access.

You agree not to:

• create accounts using false identities;
• impersonate another person or organisation;
• share your account in a way that compromises platform security.

We may require verification of account information where reasonably necessary.

Creators may create profiles and submit event listings for review.

By creating a Creator account, you confirm that:

• the information you provide is accurate;
• you have permission to publish all submitted content;
• you have the rights to use any photographs, logos or other materials you upload;
• your listings comply with applicable laws and these Terms.

Creators remain responsible for the accuracy of their listings and for delivering the events they publish.

All event submissions are reviewed before publication.

Shumbi may:

• approve a listing;
• request changes before publication;
• decline a listing;
• remove a listing after publication where necessary.

Publication on Shumbi does not constitute an endorsement of an event or creator.

Creators are responsible for ensuring that event information remains accurate and up to date, including dates, times, locations, pricing and booking information.

6A. Accuracy of Information

While we encourage creators to keep their listings accurate and up to date, event details may occasionally change.

Users should confirm important information such as dates, times, locations, pricing and availability with the event organiser before making travel plans or purchases.

We want Shumbi to be a welcoming, respectful and trustworthy place for everyone.

By using Shumbi, you agree to:

• treat other users, creators and organisers with respect;
• provide accurate and honest information;
• communicate in a respectful manner;
• respect the intellectual property and rights of others;
• use the platform in accordance with applicable laws.

You must not use Shumbi to:

• publish false, misleading or deceptive information;
• impersonate another person or organisation;
• upload content you do not have permission to use;
• engage in harassment, abuse or discriminatory behaviour;
• promote illegal activities;
• interfere with the operation or security of the platform;
• attempt to gain unauthorised access to accounts or systems;
• use automated tools to scrape or copy significant portions of the platform without permission.

Our goal is to foster a positive community that supports genuine local experiences.

You retain ownership of the content you create and upload to Shumbi.

By submitting content to the platform, you grant Shumbi a non-exclusive, worldwide, royalty-free licence to display, reproduce, format and promote that content solely for the purpose of operating, marketing and improving the Shumbi platform.

This licence allows us, for example, to:

• display your event listings;
• feature your creator profile within Shumbi;
• include your listings in search results and promotional collections;
• promote your public listings through Shumbi's marketing channels.

You confirm that you have the necessary rights or permissions to upload any content you submit.

Nothing in these Terms transfers ownership of your intellectual property to Shumbi.

Likewise, the Shumbi name, logo, branding, website design and original platform content remain the property of Shumbi unless otherwise stated.

To help maintain the quality and integrity of the platform, all event listings are subject to moderation.

Shumbi reserves the right to:

• review submitted content;
• request edits before publication;
• decline submissions;
• temporarily hide listings;
• remove listings that breach these Terms or applicable laws;
• suspend or remove accounts in serious or repeated cases.

Where practical, we will generally seek to explain the reason for significant moderation decisions and provide creators with an opportunity to correct genuine mistakes.

Our moderation decisions are intended to protect the quality, safety and trustworthiness of the platform.

Some event listings or creator profiles may include links to third-party websites or booking platforms.

These links are provided for convenience only.

Shumbi does not control or endorse third-party websites or services and is not responsible for their content, availability, privacy practices or terms.

Before making bookings or purchases through third-party services, you should review their own policies and terms.

We aim to keep Shumbi available and operating reliably.

However, we cannot guarantee that the platform will always be uninterrupted, error-free or available at all times.

From time to time we may:

• perform maintenance;
• release updates;
• improve features;
• temporarily suspend parts of the service;
• experience unexpected outages.

We appreciate your patience whenever maintenance or technical issues occur.

Shumbi is a discovery platform.

Unless expressly stated otherwise, Shumbi does not organise, manage or operate the events listed on the platform.

Creators are responsible for:

• organising their events;
• ensuring event information is accurate;
• complying with applicable laws;
• delivering the experiences they advertise.

While we review listings before publication, we cannot guarantee the accuracy, quality, safety, legality or availability of every event.

Users should exercise their own judgement before attending events or making purchases.

To the fullest extent permitted by applicable law, Shumbi is not liable for any indirect, incidental, consequential or special loss or damage arising from the use of the platform.

This includes, but is not limited to:

• cancelled or rescheduled events;
• inaccurate information supplied by creators;
• technical interruptions or temporary unavailability of the platform;
• loss arising from decisions made based on information published on Shumbi.

Nothing in these Terms excludes or limits any rights that cannot be excluded under applicable consumer protection laws, including the Australian Consumer Law.

We hope never to need to remove anyone from the Shumbi community, but we may suspend or terminate accounts where reasonably necessary to protect the platform or its users.

This may occur where a user or creator:

• repeatedly breaches these Terms;
• publishes unlawful or misleading content;
• infringes the intellectual property rights of others;
• attempts to compromise the security or operation of the platform;
• engages in abusive, fraudulent or harmful behaviour.

Where appropriate, we will generally seek to notify users of the reason for suspension and, where possible, provide an opportunity to resolve the issue before permanent termination.

Serious breaches may result in immediate suspension or removal.

As Shumbi grows and introduces new features, these Terms may be updated from time to time.

When significant changes are made, we will update the "Last Updated" date at the beginning of this document and, where appropriate, notify registered users through the platform or by email.

Your continued use of Shumbi after updated Terms come into effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising in connection with these Terms or the use of Shumbi will be subject to the jurisdiction of the courts of New South Wales, unless applicable law provides otherwise.
